This Privacy Policy explains what data we collect when you use the Service, why we collect it, how we protect it, and what rights you have over it. It applies to all TrainersEye and MoPro products, including the iOS apps, the Android apps, the web tools hosted on trainerseye.com, and our developer and business APIs.
02Corporate Structure & Affiliates
TrainersEye Technologies LLC is an independent commercial company. It is legally and financially separate from the MMSx Authority Institute for Movement Mechanics & Biomechanics Research, Inc., from the Journal of Movement Mechanics & Biomechanics Science (JMMBS), and from any other academic, certification or publishing body that may share founders, branding heritage or scientific advisors with us.
Because these organisations are separate legal entities, they are treated as third parties under this policy. That means:
- Your account, subscription, billing and usage data stays with TrainersEye Technologies LLC.
- No affiliate, partner institute, journal or certification body receives your personal data automatically.
- Scientific content, protocols and reference frameworks used inside the Service are licensed to us — licensing content does not transfer your data.
- Any transfer of personal data to a research partner happens only with your separate, explicit opt-in consent, which you can withdraw at any time (Section 08).
We may update this Policy to reflect changes in law, technology, or our services. The version number and effective date shown at the top of this page identify the operative text; that version supersedes all earlier ones. Where a change materially affects how we handle your personal data, we will notify you in the application and by email before it takes effect. The entity responsible for your data is named in Section 1 and in the entity card in the footer.
If we are ever involved in a merger, acquisition, financing or sale of assets, we will notify you before your personal data is transferred and becomes subject to a different privacy policy.
03Data We Collect
We collect the following categories of data. Required data is essential for the Service to function; optional data enhances your experience but can be declined without losing access to the rest of the Service.
| Data Type | Examples | Status |
|---|---|---|
| Account | The TrainersEye app does not require an account. Where you contact us, or where a business or web account is created for you, we hold your name, email address and sign-in details | Required |
| Subscription | Tier, plan duration, renewal status, purchase token from Apple or Google | Required |
| Device | IP address, OS version, device model, app version | Required |
| Usage | Features accessed, session duration, diagnostic logs | Required |
| Movement data | Pose landmarks, joint angles, session scores | Optional |
| Fitness goals | Training objectives, body metrics, nutrition preferences | Optional |
| Camera feed | Processed locally on device; not transmitted or stored | Optional |
| Step count | Daily step totals from device motion sensors | Optional |
We do not collect payment card numbers. Consumer subscriptions are sold through Apple In-App Purchase and Google Play Billing, which act as merchant of record and process your payment details directly under their own privacy policies. Business and API customers are billed separately; see Section 09.
04Device Permissions
Depending on which features you use, TrainersEye may request the following permissions on your device:
- Camera — for real-time pose detection in TrainersEye Coach, MMSx-SCAN and Clinical Screen Pro tools. Requested only when you actively open these tools.
- Motion & Fitness — for step counting in Mile Tracker. You can grant or revoke this in device Settings at any time.
- Microphone — reserved for future voice-coaching features. Currently unused.
- Notifications — for daily reminders and session updates. Fully optional.
- Photos/Storage — only when you export a PDF report or save a session image.
You can revoke any permission from your device Settings without losing access to the rest of the Service.
05How We Use Your Data
We use the data we collect exclusively for the following purposes:
- To provide, maintain and improve the TrainersEye and MoPro services and their tools
- To deliver personalised movement analysis, training sessions, nutrition plans and mobility protocols
- To verify your subscription or API plan and unlock the features included in it
- To communicate with you about your account, subscription or service updates
- To detect, prevent and address technical faults, abuse or security threats
- To contribute anonymised, aggregated data to independent scientific research — only where you have given explicit opt-in consent (Section 08)
- To comply with legal obligations, including tax, accounting and consumer-protection requirements
We do not use your data for targeted advertising, profile scoring, credit or insurance decisions, or sale to third parties.
06Legal Bases for Processing
Where the EU/UK General Data Protection Regulation applies, we rely on the following legal bases:
| Processing | Legal Basis |
|---|---|
| Providing the Service and, where you have one, your account | Performance of a contract (Art. 6(1)(b)) |
| Subscription, API plan and entitlement checks | Performance of a contract (Art. 6(1)(b)) |
| Security, fraud prevention, diagnostics | Legitimate interests (Art. 6(1)(f)) |
| Movement, body-metric and goal data | Explicit consent (Art. 6(1)(a) and, where applicable, Art. 9(2)(a)) |
| Research participation | Explicit consent (Art. 6(1)(a)) |
| Tax and accounting records | Legal obligation (Art. 6(1)(c)) |
Where processing relies on consent, you may withdraw that consent at any time without affecting the lawfulness of processing carried out before withdrawal.
08Optional Research Participation
TrainersEye works with independent research organisations, including the MMSx Authority Institute for Movement Mechanics & Biomechanics Research, Inc., on the study of human movement. Participation is entirely optional and is off by default.
- You must give separate, explicit opt-in consent before any of your data is used for research.
- Data shared for research is de-identified: direct identifiers such as your name, email address and device identifiers are removed before transfer.
- You can withdraw consent at any time in your account settings or by emailing us; withdrawal stops any further use of your data, although results already published cannot be un-published.
- Declining research participation never affects your access to the Service or your subscription.
Where a study qualifies as human-subjects research, it is conducted under the sponsoring organisation's own ethics approval and informed-consent process, which is separate from and additional to this policy.
09API, Developer & Business Customers
We offer the TrainersEye API, the MoPro API and related business services to organisations such as gyms, clinics, universities, sports teams and software companies ("Customers"). Two different roles apply, and it matters which one you are.
If you are our Customer
We are the controller of the data about your organisation and its users of our developer console: contact name, business email, company name, billing details, API keys, request logs, quota and usage metrics, and support correspondence. We use it to authenticate requests, meter usage, bill you, prevent abuse and provide support.
If you are an end user of a Customer's product
When a Customer sends data to our API — for example a video frame, a set of pose landmarks, a screening result or a written query — we act as a processor on that Customer's instructions. The Customer is the controller and decides what is sent, why, and for how long it is kept.
- We process API content only to return the requested result and to keep the service secure and operational.
- We do not use Customer API content to train or fine-tune our models, and we do not use it for research, marketing or profiling.
- We do not sell, share or reuse Customer API content for our own purposes.
- If you want to access, correct or delete data held in a Customer's product, contact that Customer first; we will assist them in responding.
API access is governed by our developer terms and, where required, a Data Processing Addendum incorporating the European Commission's Standard Contractual Clauses. Customers may request a DPA from privacy@trainerseye.com.
Retention and safeguards for API traffic
- Request and response content — processed transiently and not retained beyond what is needed to return the result, unless the Customer has enabled a storage feature or asked us to retain it in writing.
- Operational and security logs — metadata such as timestamp, endpoint, key identifier, status code and payload size, retained for up to 90 days for abuse prevention, debugging and billing accuracy.
- Abuse investigations — content may be retained longer where we are investigating a specific security incident or a suspected breach of our terms.
10Storage & Security
Your data is encrypted in transit using TLS and at rest using AES-256. Access is restricted to authorised personnel under written confidentiality agreements, and administrative access is logged. API keys are stored as hashed values, can be rotated or revoked by the Customer at any time, and are transmitted only over encrypted connections. We review our security configuration regularly and maintain an incident-response procedure.
11Data Retention
We retain your data only for as long as necessary to deliver the Service or as required by law:
- Account data — retained while your account is active, and for 30 days after deletion to allow recovery
- Session data (movement, nutrition, training) — retained for 24 months, then deleted or anonymised
- API request content — transient; not retained unless a storage feature is enabled or retention is agreed in writing (Section 09)
- API and developer-console logs — retained for 90 days
- Billing and tax records — retained for 7 years to comply with US tax law
- Technical logs — retained for 90 days for security and debugging
- De-identified research data — retained for the lifetime of the relevant study and its archiving requirements; it is no longer linked to you
You can request immediate deletion of your account and associated data at any time (see Section 12).
12Your Rights (GDPR & CCPA)
Regardless of where you live, TrainersEye honours the following rights for every user:
- Access — request a copy of all personal data we hold about you
- Correction — update inaccurate or incomplete information
- Deletion — request removal of your account and all associated data ("right to be forgotten")
- Portability — receive your data in a machine-readable JSON format
- Objection — opt out of specific processing activities, such as research inclusion
- Restriction — pause processing while we resolve a dispute
- Withdrawal of consent — revoke any consent you previously granted
- Non-discrimination — exercising any of these rights never results in reduced service or different pricing
- Complaint — lodge a complaint with your local supervisory authority
California residents may additionally request disclosure of the categories of personal information collected, used and disclosed in the preceding 12 months. We do not sell or share personal information as those terms are defined by the CCPA/CPRA.
To exercise any of these rights, email privacy@trainerseye.com. You can also delete your account from within the app. We verify requests against the email address on your account and respond within 30 days. If your data reached us through a business or API Customer, please contact that Customer directly — we will support their response as their processor.
13Children's Privacy
TrainersEye is intended for adult users (18+) and qualified health, fitness and clinical professionals. The Service is not directed at children under 13, and we do not knowingly collect personal data from children under 13. If we become aware that a child under 13 has provided us with personal data, we will delete that data promptly.
Users aged 13–17 may use the Service only with the involvement and consent of a parent or legal guardian. Customers must not transmit data relating to children under 13 through our APIs.
14International Data Transfers
TrainersEye Technologies LLC is based in the United States (Powell, Ohio), and some of our contractors and service providers operate from India and other countries. When you use the Service, your data may be transferred to, stored in or processed in countries other than your own.
For transfers from the EEA, UK and Switzerland, we rely on the European Commission's Standard Contractual Clauses (and the UK International Data Transfer Addendum where applicable) as a legal safeguard, together with supplementary technical measures such as encryption, so that your data receives protection equivalent to European law.
16Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, our corporate structure or our legal obligations. When we make material changes, we will update the "Last Updated" date and version number at the top of this page and, where appropriate, send an email notification or in-app alert. Business and API Customers receive notice through the channel set out in their agreement.
Continued use of the Service after an update constitutes acceptance of the revised policy. We encourage you to review this page periodically.
